1. Who we are

This website, etchelle.com, and the store operated through it (the “Site”) are operated by Luvid LLC, a limited liability company registered in the United States, trading as Etchelle. In these Terms, “we”, “us” and “our” mean Luvid LLC.

“Etchelle” is the brand under which Luvid LLC sells the products on this Site. Your contract of sale is with Luvid LLC.

2. Agreement to these terms

These Terms of Service (the “Terms”) govern your use of the Site and any order you place with us. By browsing the Site or placing an order, you agree to these Terms.

Our Privacy Policy, Refund Policy and Shipping Policy form part of these Terms. Where a specific policy covers a topic in more detail, that policy governs on that topic.

If you do not agree to these Terms, please do not use the Site.

3. Who may buy from us

You must be at least 18 years old, or the age of majority where you live, to place an order. If you are younger, you may use the Site only with the involvement of a parent or guardian, who accepts these Terms on your behalf.

We ship to the countries listed at checkout. If your country is not offered, we cannot accept your order.

4. What we sell

We sell two kinds of product, and different things matter for each.

Skincare and cosmetics. These are cosmetic products for external use on the skin. They are not medicines and are not intended to diagnose, treat, cure or prevent any disease. Please read section 12 before you buy.

Advent calendars and squishy toys. These contain small parts and are not suitable for children under 3 years old. Adult supervision is recommended. They are novelty items, not food, and must not be put in the mouth. Keep packaging away from small children.

Product images are illustrative. Colours can look different between screens, and packaging and formulations may change. Surprise or mystery items vary by unit — you are buying the assortment described on the product page, not a specific item within it.

5. Accounts

You do not need an account to order. If you create one, keep your password to yourself and tell us promptly if you think someone else has access to it. You are responsible for what happens under your account.

6. Orders, prices and acceptance

Placing an order is an offer to buy. A contract is formed when we send you a dispatch confirmation, not when you receive an order confirmation email and not when your card is authorised.

We may decline or cancel an order, in whole or in part, if the item is out of stock, if there is an error in the price or description, if we suspect fraud or reselling, or if we cannot ship to your address. If we cancel an order you have paid for, we refund you in full.

All prices are in US dollars and exclude shipping and any import charges. We try to keep prices and descriptions accurate, but pricing errors happen. If an item is listed at an obviously wrong price, we are not obliged to sell at that price; we will contact you and give you the choice of paying the correct price or cancelling.

7. Payment

Payment is taken through Shopify’s payment providers at checkout. We do not see or store your full card details. You confirm that you are authorised to use the payment method you enter.

8. Shipping, delivery and risk

Shipping timeframes, tracking, and what happens with lost or misaddressed parcels are set out in our Shipping Policy. Delivery estimates are estimates, not guaranteed dates.

Risk of loss passes to you when the carrier delivers the parcel to the address you gave us.

9. International orders, duties and taxes

If you order from outside the United States, your local authority may charge import duties, taxes or customs fees. These are not included in what you pay us and are your responsibility. We cannot predict them and cannot refund them. Refusing a parcel to avoid duties does not entitle you to a refund of shipping costs.

You are responsible for making sure the products you order may lawfully be imported into your country.

10. Returns, refunds and the money-back guarantee

Our Refund Policy sets out the full terms, including our money-back guarantee, and it governs in the event of any conflict with marketing material, landing pages, advertisements or anything said by a third party. If an offer you saw elsewhere differs from the Refund Policy, the Refund Policy is what applies.

Contact us before returning anything. Items sent back without prior arrangement cannot be processed.

11. Promotions, discount codes and offers

Promotions, bundles, free-gift offers and discount codes are limited-time and may be changed or withdrawn at any time before you place your order. They cannot be combined unless we say so, have no cash value, and apply only while stocks last.

If a promotion is advertised with terms that differ from these Terms, the terms published on the promotion page apply to that promotion. We may cancel orders placed using a code obtained through error, abuse, or bulk distribution.

12. Cosmetic products: what you should know before buying

Our skincare products are cosmetics. Statements about them have not been evaluated by the Food and Drug Administration or by any equivalent authority in your country.

Nothing on this Site is medical advice. Content on the Site, including articles, testimonials, before-and-after images and statistics, is provided for general information and marketing. Individual results vary, and results shown are not a promise of what you will experience.

Read the ingredient list before use. If you have sensitive or reactive skin, a known allergy, a skin condition, or you are pregnant or breastfeeding, patch test first and speak to a qualified healthcare professional if you are unsure. Stop using the product and seek advice if irritation occurs. Keep away from eyes and do not swallow.

If you rely on a specific ingredient being present or absent, check the current ingredient list on the product page before ordering, as formulations can change.

13. Reviews and anything you post

If you send us a review, photo, video or comment, you keep ownership of it, but you give us a non-exclusive, worldwide, royalty-free licence to use, reproduce and display it in connection with our business, including in advertising, without payment to you.

You confirm that what you submit is your own, is truthful, and does not infringe anyone’s rights. We may edit for length or decline to publish anything, and we may remove content at any time.

14. Our intellectual property

The Etchelle name and logo, the Site’s design, text, photography, video and product imagery belong to Luvid LLC or our licensors. You may not copy, reproduce, republish or use them commercially without our written permission. You may share links to the Site freely.

15. Acceptable use

Do not use the Site to break the law, to harass anyone, to submit false information, to place fraudulent orders, or to interfere with the Site’s operation or security. Do not scrape, mine, or copy the Site’s content in bulk, and do not resell our products as an authorised retailer without our written agreement.

We may suspend or refuse service to anyone who breaches this section.

16. Third-party links and services

The Site links to and relies on third-party services, including payment processors, carriers and analytics providers. We are not responsible for the content, policies or practices of third-party sites. Their terms apply to your use of them.

17. Availability of the Site

We do our best to keep the Site running, but we do not guarantee it will be uninterrupted or error-free. We may change, suspend or withdraw any part of the Site, or any product, at any time.

18. Disclaimer of warranties

Except where the law says otherwise, the Site and the products are provided “as is” and “as available”, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.

Nothing in these Terms limits any right you have under consumer protection law that cannot be limited by agreement. If you are a consumer in the EU, the UK, Australia or another jurisdiction with mandatory consumer guarantees, those rights apply in addition to these Terms.

19. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential losses, or for loss of profit, revenue, data or goodwill, arising from your use of the Site or the products.

Where we are liable, our total liability for any claim is limited to the amount you paid for the order that gave rise to the claim.

Nothing in these Terms excludes liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.

20. Indemnity

You agree to indemnify us against claims, losses and reasonable legal costs arising from your breach of these Terms or your misuse of the Site.

21. Governing law and disputes

These Terms are governed by the laws of the State of Montana, United States, without regard to its conflict of law rules. Disputes will be brought in the state or federal courts located in Montana, and you and we consent to their jurisdiction.

If you are a consumer resident in the EU or the UK, this does not deprive you of the protection of the mandatory consumer laws of your country of residence, and you may bring proceedings there.

Please contact us first. Most problems are faster to fix by email than by anything else.

22. Changes to these Terms

We may update these Terms from time to time. The version in force when you place an order is the version that applies to that order. The date at the top shows when we last made changes.

23. General

If any part of these Terms is found unenforceable, the rest continues to apply. Our not enforcing a right on one occasion does not waive it. You may not transfer your rights under these Terms; we may transfer ours if our business is sold or reorganised.

These Terms, together with the policies referred to in section 2, are the entire agreement between you and us about the Site and your order.
